Terms & Conditions

Digilab Printing will fulfil orders for its customers on the basis that the customer understands and accepts the terms and conditions as outlined below. The terms prevail over any written terms and conditions provided by Digilab Printing customers. Any variation of the terms must be agreed with Digilab Printing.

Images

Images should be supplied in jpeg or flattened tiff formats only. Information and advice on preparation and sending files is available via the "Upload Photos" section of the website. Whilst every effort will be made to check image files it is the responsibility of the customer to check that supplied files are ready to print. Digilab Printing will reserve the right to charge the customer for sending reprints of files supplied incorrectly.


Digilab Printing accepts no responsibility for any breaches of copyright or licensing rules relating to any supplied images. Digilab Printing will assume that there are no copyright issues relating to supplied images – it is therefore the responsibility of the customer to ensure that all images are cleared for use. Digilab Printing reserve the right to refuse to print images they deem to be of an unsuitable nature such as images with racist, immoral or criminal content.

Copyright

Customers must either (a) own the copyright of any images to be processed or (b) have obtained the necessary permissions of the copyright owner/s to process the image/s in the formats and numbers agreed by the copyright owner/s. Digilab Printing reserves the right to contact the copyright owners to confirm the customer has obtained the necessary copyright clearance. The customer by placing an order with Digilab Printing accepts they (the customer) have obtained the necessary copyright permissions as a result agree to indemnify Digilab Printing against all costs, claims and demands howsoever or whatsoever arising in respect of verification of copyright authority or any alleged breach of copyright by Digilab Printing. The copyright in any artwork or design created by Digilab Printing or its employees or agents is retained by Digilab Printing.

Orders and Payment

Digilab Printing work on a payment on order basis unless an account has been established with associated payment terms. After images have been uploaded, we will contact you to confirm the order and delivery details before taking payment. Payment covers the total order cost – the cost of the products together with the delivery cost. Payment can be made by Credit or Debit Card or by BACS. In the case of BACS payments we may ask for a digital payment receipt to be emailed prior to sending your order.

Delivery

The delivery prices are detailed in the relevant product sections on the website. Unless an expedited delivery is requested (Same/Next Day service) UK print orders are sent by Royal Mail 1st Class or Tracked Services. All orders are sent without exception via a tracking delivery service. Next Day services are sent via DPD Courier which includes a 1hour delivery window notification on the day of delivery. A Same Day Express delivery service is available for extremely urgent orders. Same Day services are available on request only and prices are dependent on location.


If your order arrives with visible damage to the packaging do not sign for or accept the order and contact us immediately. If you open up your order and discover damage to the products inside please contact us as soon as possible. We may ask you to photograph the damage and email us to avoid costly repackaging and return costs. In the cases of damaged or lost deliveries we will make every effort to send out a replacement as soon as possible.


No claim of consequential loss relating to the delivery, fulfilment or any other factors relating to any order will considered by Digilab Printing.


Digilab Printing will not be responsible for the failure to fulfil orders due to factors beyond its control (including but not limited to) – The failure of third parties to perform their obligations, acts of God, natural disasters, war, fire, flooding etc.

Trade Accounts

Trade accounts are available at the discretion of Digilab Printing. These are normally granted to customers with a long trading history or to approved commercial clients. Payment terms are normally 30 days from date of order and are arranged on a per customer basis. All orders made on account remain the property of Digilab Printing (t/a Sport Photo Gallery Ltd) until payment is received in full. Digilab Printing reserve the right to terminate a client account at any time without notice.

Data and Image Storage

Digilab Printing will not be responsible for the storage of customer's image files, data files or previous order specifications. Customer's material is therefore held by Digilab Printing at the customer's own risk and the customer is responsible for the insurance of this material at their own expense. Digilab Printing will never share files with any other customer unless given permission by the image/file owner.


Customers are strongly advised to ensure a back up is stored of any images uploaded to Digilab Printing. Whilst Digilab Printing will store uploaded image files on our servers for a limited time we cannot accept any responsibility for images lost or corrupted.


Digilab Printing will store image files for regular customers for longer periods if required but would suggest that these customers also keep a back up of their work.


Images will be deleted/removed from our servers if requested.

Complaints, Refunds and Credits

Digilab Printing will consider any requests for refunds or credits if notified with 14 days of receipt of an order. If you have any complaints about the products or service you have received please contact us via the Contact Us page.
